Public debate on the Draft Law on Labour in Montenegro

A Round table in the framework of the public debate on the Draft Law on Labour took place on September 22, 2017.

 Public debate on the Draft Law on Labour started on August 4, 2017, by publishing the Public Invitation in the daily newspaper "Pobjeda" and on the website of the Ministry of Labour and Social Welfare and the e-Government Portal and lasting 40 days, after which the Report on the public hearing will be prepared.

On this occasion, a review of the law was given by the Minister, General Director of the Directorate for Labour at the Ministry of Labour and Social Welfare, Secretary General of the Union of Free Trade Unions of Montenegro, Secretary General of the Federation of Trade Unions of Montenegro, Secretary General of the Union of Employers of Montenegro, the presentation of the Draft Law on Labour was held by Dr. Vesna Simović Zvicer. 

Social partners have achieved a high level of compliance within the public debate on the Draft Labour Law, but there are few institutes and norms around which there are divided opinions, Minister of Labour and Social Welfare, Kemal Purisic, announced. "There are a few other institutes and norms around which there are divided opinions. It's on the table, and this is the subject of a public debate that ends today, "Purisic said. 

When it comes to fixed-term work and work through the agency for the temporary transfer of employees, Dr. Simović reminded that according to the current law, the employer can offer a contract for a certain period of time for a maximum period of two years.

"After that period, he can hire an employee through various agencies. It can literally hire it by the end of the working life, through one, the other, the third or the tenth agency. There were no restrictions here, "said Simovic.

Related to absence due to illness, Simović explained: "In addition to the report of the doctor that the employees will be obliged to submit, he will be obliged to submit the same to the employer within three days from the date of receipt of the doctor's certificate. If there is the suspicion of the reasons for the certificate, has the right to initiate the procedure in which the certificate issued by the doctor will be reviewed, before the commission formed by the Ministry of Health”.

After the presentation participants of the public debate - representatives of organizations, associations and individuals gave proposals, suggestions and comments on the Draft law.

The Ministry of Labor and Social Welfare will consider the proposals, suggestions and comments of the participants of the public debates, after which they will prepare a Report on the conducted public debate, which will be published on the website of the Ministry of Labor and Social Welfare and the e-Government Portal within 10 days completion of the public debate.
